**Document scope.** This document applies to users accessing hermetis.io in its English, Latvian, or Lithuanian language version, and to clients served by **SIA "AGroup"** (Latvia). It is governed by **the laws of the Republic of Latvia**. Clients served by **AGroup sp. z o.o.** (Poland) operate under a separate set of documents available in the **Polish language version** of hermetis.io.
§ 1. General provisions
- These Website Terms and Conditions (hereinafter: "Terms") govern access to and use of the website available at hermetis.io (hereinafter: "Website") by users.
- The Website is operated by:

- (hereinafter: "Service Provider" or "AGroup").
- By using the Website, the user accepts these Terms and undertakes to comply with them.
- The Terms are made available free of charge at hermetis.io in a manner allowing their retrieval, reproduction, storage, and printing.
§ 2. Definitions
The following terms used in these Terms have the following meanings:
- Hermetis — an IT system in the core HR & Payroll class, offered in SaaS and on-premise models by AGroup, being the new commercial name of the system previously known as HRB Portal;
- Website — the website available at hermetis.io together with all subpages;
- User — a natural person, legal entity, or organisational unit without legal personality using the Website;
- Electronic service — a service provided by electronic means within the meaning of applicable e-commerce law, in particular the services indicated in § 3 of the Terms;
- Contact Form — an electronic form available on the Website enabling the User to establish commercial contact with the Service Provider;
- Demo Form — an electronic form available on the Website enabling the User to obtain access to an interactive presentation of the Hermetis system;
- Calendly — the meeting booking widget embedded on the Website, operated by Calendly LLC;
- Privacy Policy — the document available at hermetis.io/privacy-policy, describing the rules of personal data processing;
- Cookie Policy — the document available at hermetis.io/cookies, describing the rules of using cookies and similar technologies.
§ 3. Type and scope of services provided on the Website
- Through the Website, the Service Provider provides the following Electronic services to Users free of charge:
- making available informational content concerning AGroup, the Hermetis system, and the solutions offered by the Service Provider;
- making available a Contact Form enabling the establishment of commercial contact;
- making available a Demo Form enabling access to an interactive presentation of the Hermetis system;
- making available a meeting booking service via an embedded calendar widget (Calendly);
- making available a newsletter subscription form containing marketing, educational, and product information about AGroup and the Hermetis system;
- making available marketing, educational, and informational materials concerning the HR and Payroll area;
- other informational services indicated directly on the Website.
- Use of the Website does not entail the conclusion of an agreement for the Hermetis system services. Conclusion of an agreement for the use of the Hermetis system takes place exclusively on the basis of a separate, individually negotiated agreement concluded in written or electronic form in accordance with document form requirements.
- The Website does not enable self-service account registration in the Hermetis system or self-service acquisition of access to the Hermetis system. The entire process of concluding an agreement for the Hermetis service takes place within an individual sales process involving the AGroup team.
- The Website and the services described herein are intended exclusively for business customers (B2B). By using the Website, the User confirms that they act in a professional or business capacity and do not act as a consumer within the meaning of applicable EU or Latvian consumer protection laws.
§ 4. Technical requirements
- To use the Website, the User should have:
- a device with Internet access;
- an up-to-date web browser (Google Chrome, Mozilla Firefox, Microsoft Edge, Safari — in the version supported by the manufacturer) with JavaScript and cookies enabled;
- an active email account (for some services).
- The Service Provider does not guarantee the proper functioning of the Website on outdated browsers or in browsers with default settings modified by the User in a manner preventing the use of the Website.
- The Service Provider informs that the use of services provided by electronic means may involve risks resulting from the very nature of the Internet, in particular: malware, phishing, unauthorised access to the User's transmitted data. The User should apply appropriate technical measures to minimise these risks.
§ 5. Conditions for providing Electronic services
- The provision of Electronic services on the Website is free of charge.
- The User undertakes to use the Website in accordance with the law, the Terms, the rules of social coexistence, and good practices, in particular by refraining from:
- providing unlawful content;
- using the Website in a manner that disrupts its operation;
- attempting unauthorised access to the Website's resources or systems;
- using automated tools (bots, crawlers) to extract data from the Website without the Service Provider's consent;
- actions consisting in scraping or collecting data of other Users.
- Use of the Contact Form and Demo Form requires the provision of data marked as mandatory. The scope of data and the purposes of their processing are specified in the Privacy Policy.
- Newsletter subscription:
- subscription to the newsletter takes place by filling in the form on the Website and giving a separate consent to receive commercial information by electronic means and consent to the use of electronic communications equipment for direct marketing purposes, in accordance with applicable law;
- consent to the newsletter is voluntary and may be withdrawn at any time without affecting the lawfulness of processing carried out on its basis before withdrawal;
- unsubscription from the newsletter takes place by clicking the "Unsubscribe" link in the footer of every newsletter message or by contacting the Controller at dataprotection@hermetis.io;
- AGroup sends the newsletter as a rule no more than once a month, reserving the right to send less frequently or occasionally more frequently, in particular in the case of significant product information or industry events;
- detailed rules for processing the personal data of newsletter subscribers are set out in the Privacy Policy.
- The User is obliged to provide true and current data. The User is responsible for the consequences of providing data that is untrue, incomplete, or relating to third parties without their consent.
- The Service Provider is entitled to block the User's access to the Website if the User violates the Terms or the law, in particular in the cases referred to in section 2 above.
- The Service Provider may temporarily suspend the availability of the Website in connection with the need to carry out maintenance, modernisation, or other technical work.
§ 6. Intellectual property
- All content on the Website, including but not limited to: text, graphics, photos, descriptions of the Hermetis system, illustrations, logos, the AGroup and Hermetis trademarks, the structure and design of the Website, is the intellectual property of AGroup or its licensors and is protected by applicable provisions of intellectual property law, in particular copyright and industrial property law.
- The User may use the content of the Website only for personal informational purposes. Any other use, in particular copying, reproduction, modification, distribution, public communication, reverse engineering, or extraction of data, requires the prior written consent of the Service Provider.
- The names "AGroup" and "Hermetis" and the related graphic symbols are protected trademarks of AGroup. Their use without the Service Provider's consent constitutes a violation of the law.
§ 7. Personal data
- The Service Provider is the Controller of personal data processed in connection with the use of the Website, on the basis specified in the Privacy Policy.
- The Controller has appointed a Data Protection Officer (DPO), who can be contacted at: dataprotection@hermetis.io or in writing to the registered address of the Controller with the note "DPO — Bartosz Kapuściński".
- Detailed rules for the processing of personal data, the rights of data subjects, recipients of data, transfer of data outside the EEA, and other information required by GDPR are specified in the Privacy Policy.
§ 8. Cookies
The rules of using cookies and similar technologies are specified in the Cookie Policy available at hermetis.io/cookies.
§ 9. Liability
- The Service Provider provides services with due diligence, but does not guarantee uninterrupted, error-free, secure, or virus-free operation of the Website. The Website and its content are provided "as is" and "as available".
- The Service Provider is not liable for damages resulting from:
- the User's use of the Website in a manner inconsistent with the Terms or the law;
- circumstances beyond the Service Provider's control (force majeure, failures of internet providers, attacks on the Service Provider's infrastructure);
- actions of third parties to whom the Service Provider has entrusted the performance of specific activities (e.g. hosting providers);
- the User's loss of data resulting from failures on the User's side.
- The content of the Website is informational in nature and does not constitute a legally binding offer within the meaning of applicable civil law. A binding agreement is concluded only upon execution of a separate written agreement on the use of the Hermetis system.
- To the extent permitted by applicable law, AGroup is not liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of the Website.
§ 10. Complaints
- The User may submit complaints regarding the operation of the Website to the email address: hello@hermetis.io or to the registered address of the Service Provider.
- The complaint should contain: identification data of the User, a description of the issue raised, and, if possible, the date and circumstances of its occurrence.
- The Service Provider will consider the complaint within 30 days from the date of its receipt. The response will be sent to the address indicated in the complaint.
§ 11. Final provisions
- The Terms are governed by the laws of the Republic of Latvia.
- The Website is intended for business entities. If the User is a consumer within the meaning of applicable consumer protection laws, the User's rights arising from mandatory provisions of consumer protection law are not limited by these Terms.
- In matters not regulated by the Terms, the applicable provisions of the laws of the Republic of Latvia shall apply, including but not limited to the laws governing civil obligations, electronic commerce, intellectual property, personal data protection (together with the GDPR), consumer protection (to the extent the User is a consumer), and electronic communications.
- Any disputes arising from these Terms or in connection with them shall be resolved:
- primarily amicably;
- in the absence of agreement — by the common court having jurisdiction over the registered office of the Service Provider, i.e. the competent courts of the Republic of Latvia (subject to mandatory provisions, in particular those applicable to consumers).
- If any provision of the Terms proves to be invalid or unenforceable, the remaining provisions remain in force. An invalid or unenforceable provision shall be replaced by a provision closest in content, compliant with the law and the parties' intent.
- The Terms enter into force on 31 May 2026.
